Readers respond to France's inheritance law update

One reader warns that officials may still find loopholes

I read with great pleasure the confirmation that wills electing the law of England and Wales are not affected by a French forced-heirship law introduced in 2021.

My wife died in January 2025. Our wills were written in January 2016 and included the wording given to us by the notaire concerning English and Welsh law.

The probate has been held up because one of her two daughters refused to reply to questions from the notaire and there was no time limit for non-responses.

When I suggested to my notaire’s clerk last year (while the European Commission was demanding a response to their questions on this subject) that I was hoping to move forward with my late wife’s probate, she laughed and said it would not do me any good because my wife died while the 2021 law was in place and so it was unlikely to be retrospective.

If the French authorities accept that wills written under English/Welsh law should not be required to comply with the 2021 Act, is that not retrospective?

If vague, is there time for clarification, before notaires are notified? Otherwise it leaves scope for interpretation by each individual notaire!

To the Editor,

A word of warning, having read that the French government will now recognise UK wills.

Our notaire has advised that as my wife’s will did not specify that she wished it to be administered under the law of England and Wales, French inheritance rules would apply.

We certainly were not aware of this. If this is correct, make sure you have a codicil attached to any existing will.
