Second homes and Brexit cards

We are UK citizens with a French second home. We have 10-year Brexit Withdrawal Agreement residency cards. Will EES apply to us? 

If you have a residency card for France you can show this at the border and you should not be subject to EES. 

Please note though that WA residency cards were originally intended for people whose main home was in France rather than second-home owners spending most of the year elsewhere.

However, these residency rights are still retained should you be away from France for up to five years. The French authorities have not specifically defined what ‘being away’ from France means in this context.
