Our notaire is taking a really long time to deal with an inheritance. What can we do to avoid a fine for late declaration?

Sometimes the allotted six months are not enough for the notaire to finish working out the value of the estate, in which case it is possible for him or her to make a provisional declaration of the values that are known. In such as case only the extra value declared from six to nine months after the death will give rise to late payment penalties.

If the notaire is at fault you can ask him or her to use their professional insurance to reimburse you for late payment penalties.

If he or she refuses, your options include going to the mediator, complaining to the Chambre départementale des notaires, or engaging an avocat to sue the notaire in the Tribunal de grande instance. You can change notaires if you are dissatisfied with a notaire's work.
