Husband fined For lack of sex

A Niçois man has been fined €10,000 for not making love to his wife often enough

FOR only the second time in France a husband has been fined for not fulfilling his marital duties with sufficient regularity.

A 51-year-old Niçois, only referred to as Louis B, was fined €10,000 damages for not making love to his wife enough during their 21-year marriage, reports the French national media this week (even though the case dates to May).

The judgement was part of divorce proceedings, and the lack of bedroom activity was also accepted as proof that the break up was entirely the husband’s fault.

Mr B. justified himself by saying he had health problems and chronic fatigue due to difficult working hours, however this did not convince the court, said Le Parisien.

The decision was based on article 215 of the Civil Code, which says that a husband and wife should have a “shared life”, which the judge said implied they would have sex together.

According to Europe 1 radio the only other case dated to 2000. A lawyer told the station that the decision was justified by French law, but usually in such cases the husband refuses to admit the facts, which are hard to prove.
